Legal Battle Calls 25th Street Station Into Question

The seller of an 11-acre parcel at 25th and Howard streets is taking legal action to terminate the sale of the property to a developer.

The future of a hotly debated Walmart planned for Remington is in doubt after the seller of the 11-acre site for the development terminated the sale and started legal proceedings against the developer. 

The Baltimore Sun reported Thursday morning that Bruce Mortimer, president of the Anderson Auto Group, whose family owns the property at 25th and Howard streets that was to be the home of the Walmart store, asked a circuit court judge to declare the sale of the property legally terminated.

The lawsuit stems from an incident last year, when developer WV Urban Developments, headed by Rick Walker, missed a Sept. 30 deadline to complete an agreement with Walmart in which the company would agree to purchase a portion of the properties on the Remington site, the Sun reports.

The a judgement in Mortimer's favor would mean that the contract between Mortimer's Twenty Fifth Street LLC and the developer is void.

Mortimer told the Sun Wednesday that he "wants a court ruling 'that my purchase agreement with [Walker] is no longer in effect' and that 'I am out of the contract.'"

But, he told the paper, it doesn't mean the development won't go forward.

"It doesn't mean the development won't happen, but I need to resolve this issue before I can go any further."
