The former owner of the theater must also avoid all contact with its current owners.
Tom Kiefaber, the former owner of the Senator Theatre, received probation before judgment as part of a plea deal on second-degree assault and harassment charges on Wednesday in Baltimore District Court. As part of the plea deal, Kiefaber is placed on unsupervised probation for a year, must show proof that he has completed an anger management course, stay away from the Senator Theatre and abstain from any contact with its current owners. Associate Judge Jennifer Etheridge also explained to Kiefaber that he is prohibited from making any posts on social media that could be construed as a personal attack on either of the owners, James "Buzz" Cusack, his daughter and business partner Kathleen Lyon and her husband Christopher Lyon. Comptroller Joan Pratt was the only member of the city’s spending board to object.
The Board of Estimates agreed to sell the Senator Theatre to its current operators, despite the objections of its former owner and his supporters. The deal for the theater, which has been under city control since 2009, would sell the property to James "Buzz" Cusack and his daughter and business partner Kathleen Lyon as Senator Theatre, LLC, who were leasing the property. The city will provide a $700,000 loan for the project and will hold its $500,000 mortgage. The overall cost of rehabbing the 1939 art deco building is expected to be $3.49 million, and Senator Theatre, LLC has already placed $950,000 in equity into the building. Comptroller Joan Pratt was the only board member to vote against the sale, and opposed the initial agreement …

The former owner of the Senator told the court that he is “indigent” and "basically homeless."
The trial date for Tom Kiefaber, who is facing charges including second-degree assault and trespassing, has been postponed until Nov. 5. A Baltimore City District Court judge ordered the trial delayed because the assault charge, which was placed on the stet docket following an incident last year, was just reopened at the behest of the state. Kiefaber also told the judge that he needed time to arrange for a public defender because he is "indigent" and "basically homeless." He would also say in court that the charges were an attempt to harass a private citizen who was advocating for the Senator Theatre. "This is all just basically a show," Kiefaber said. Kiefaber was arrested in August on trespassing charges outside of the Senator Theatre. …

A proposal to terminate the lease and sell the historic theater will be heard on Wednesday morning.
(UPDATE) 8:58 p.m.—The city will officially submit a proposal to sell the Senator Theatre to its current operators on Wednesday. Under the proposed arrangement, the city will hold the $500,000 Purchase Money Mortgage on the property. The agreement would terminate the current lease of the building—operated by James "Buzz" Cusack and his daughter Kathleen Lyon as Senator Theatre, LLC—and sell the building to its tenants. The city’s director of finance has recommended the approval of the sale, according to the Board of Estimates agenda. The agenda also states that the project’s financing needed to be revised because construction bids for the renovations were higher than anticipated. "The new financing strategy centers on a sale of the …

Detractors of the Senator Theatre's current operators question materials proposed for outer renovations of the building.
Even selecting the color of the brick used for the rehab of the Senator Theatre can draw protests. On Tuesday, the Commission for Historical and Architectural Preservation voted to allow developers to use “golden rod” brick for the planned renovations of the historic art deco movie theater. But the commission added the caveat that it makes an on site visit within next two month to review the work. But critics of the proposed redevelopment sent emails and letters critical of the proposal that were read on to the record. Click here to read some of the letters. Currently James “Buzz” Cusack and his daughter Kathleen Lyon, the theater’s operators, intend to add three more screens and restore the interior of the building. The renovation of the …
